‘No error’: Supreme Court rejects review petitions to reconsider order on same-sex marriage

The Supreme Court has dismissed review petitions challenging its October 2023 judgment, which denied the recognition of same-sex marriages and civil unions. In its order, the court stated: “We have carefully examined the judgments delivered by Hon’ble Mr. S. Ravindra Bhat (Former Judge) on behalf of himself and Hon’ble Ms. Justice Hima Kohli (Former Judge), as well as the concurring opinion by Hon’ble Mr. Justice Pamidighantam Sri Narasimha. The majority view reflects the correct interpretation of law, and no apparent error is found on record. Thus, no interference is warranted. The review petitions are dismissed.” The bench also disposed of all pending applications related to the matter.  The petitions sought a review of the October 17, 2023, ruling by a constitutional bench comprising then Chief Justice of India D Y Chandrachud and Justices S K Kaul, S R Bhat, Hima Kohli, and P S Narasimha. The court had unanimously declined to legalize same-sex marriages and, by a 3-2 majority, denied adoption rights to queer couples.
